Terms and Conditions
Last Updated: September 2026
These Terms & Conditions (“Terms”) govern your access to and use of the TS Firearm LLC website (the “Site”) and your purchase of products from TS Firearm LLC (“TS Firearm,” “we,” “us,” or “our”).
By accessing or using this Site, creating an account, or placing an order, you agree to these Terms and to any policies incorporated into these Terms by reference, including our Shipping Policy, Return & Cancellation Policy, and Privacy Policy.
If you do not agree to these Terms, do not use the Site or place an order.
1. Legal Eligibility and Customer Responsibility
You are responsible for ensuring that your use of this Site and any product you purchase complies with all applicable federal, state, and local laws.
Firearms, ammunition, magazines, and certain other products may be restricted or prohibited in certain jurisdictions. It is your responsibility to determine whether you may legally purchase, possess, receive, transfer, or use a product before placing an order.
TS Firearm will not knowingly ship a product to a jurisdiction or recipient where the sale, shipment, transfer, possession, or delivery is prohibited by applicable law.
By ordering a regulated product, you represent that you are legally eligible to purchase and receive that product and that the information you provide to TS Firearm is complete and accurate.
TS Firearm reserves the right to refuse or cancel any transaction that we believe may violate applicable law, involve fraud or misuse, or otherwise present a legal or compliance concern.
2. Firearm Purchases and FFL Transfers
Firearms purchased through the Site must be shipped to a valid Federal Firearms Licensee (“FFL”) where required by law. TS Firearm does not offer local pickup or face-to-face transfers.
The customer is responsible for selecting an appropriate receiving FFL and ensuring that TS Firearm receives all information and documentation necessary to complete shipment.
The receiving FFL is responsible for completing the transfer in accordance with applicable law, including any required background check, identification, waiting period, permit, or other transfer requirement.
Before completing the transfer, you should inspect the firearm at your receiving FFL for visible damage, defects, incorrect model or configuration, or other apparent problems.
Do not complete the transfer if you believe the firearm you received is incorrect or has been materially damaged during shipment. Contact TS Firearm before completing the transfer so that the issue can be evaluated.
Once a firearm has been legally transferred to you by the receiving FFL, the sale is final and the firearm cannot be returned to TS Firearm except where otherwise required by applicable law.
3. Failed, Denied, or Incomplete Firearm Transfers
You are responsible for determining your eligibility to receive a firearm before placing an order.
If a firearm has been shipped to an FFL and the transfer cannot be completed because of a failed or denied background check, buyer ineligibility, missing buyer documentation, failure to satisfy applicable legal requirements, refusal or failure to complete the transfer, or another circumstance attributable to the customer, the firearm may be returned to TS Firearm where permitted and appropriate.
If TS Firearm accepts the firearm back under these circumstances, any refund will be reduced by a 15% restocking fee, original shipping charges, return shipping charges, and other nonrefundable costs reasonably incurred in connection with the transaction.
A firearm that has already been legally transferred to the customer is not eligible for return under this provision.
4. Ammunition, Magazines, and Other Restricted Products
TS Firearm may offer ammunition, magazines, firearm accessories, and other products that are subject to federal, state, or local restrictions.
We will not knowingly ship a restricted product to a jurisdiction where its sale, shipment, possession, transfer, or delivery is prohibited.
Customers are responsible for knowing and complying with the laws applicable to their location.
Certain products may require additional documentation, age verification, shipment to an FFL or other licensed entity, or other compliance procedures before an order can be fulfilled.
TS Firearm may cancel or modify an order when necessary to comply with applicable law. If TS Firearm determines that it cannot lawfully fulfill an order through no fault of the customer, the affected product will be canceled and the applicable amount refunded.
5. Orders and Order Acceptance
Submitting an order through the Site constitutes an offer to purchase the products identified in the order.
Receipt of an automated order confirmation does not necessarily constitute final acceptance of the order.
TS Firearm reserves the right to review, accept, decline, hold, or cancel an order for reasons including, but not limited to:
- product availability;
- incorrect pricing or product information;
- distributor or inventory-feed errors;
- suspected fraud or unauthorized payment activity;
- inability to verify information;
- failure to provide required FFL or other documentation;
- legal or regulatory restrictions; or
- other circumstances that prevent TS Firearm from lawfully or reasonably fulfilling the transaction.
If TS Firearm cancels an order because we or our distributor cannot fulfill it, the customer will receive a refund of the applicable amount paid for the canceled product.
6. Product Availability and Distributor Fulfillment
Some products offered on the Site may be fulfilled or shipped directly by third-party distributors.
Inventory information may be provided through automated distributor feeds and can change rapidly. An indication that an item is “in stock” does not guarantee that inventory will remain available until the order has been processed.
If a product becomes unavailable after an order is placed, TS Firearm may cancel the affected item and issue a refund.
Where appropriate, we may contact you regarding an alternative product. TS Firearm will not substitute a different product without your approval.
Orders containing multiple products may be fulfilled from different locations and may arrive in separate shipments.
7. Pricing and Errors
We make reasonable efforts to provide accurate product descriptions, specifications, availability, and pricing. However, errors may occur, including errors originating from manufacturers, distributors, automated inventory feeds, or other third-party data sources.
TS Firearm reserves the right to correct typographical, pricing, product-description, inventory, or technical errors at any time.
If an item is listed at an incorrect price or with materially incorrect information, TS Firearm may cancel the affected order and refund the amount paid for that item.
We are not obligated to honor an obviously erroneous price or product listing.
8. Product Images and Stock Photography
Product images are provided for general reference and may include manufacturer-supplied or other stock photography.
Unless a listing expressly states that the photograph depicts the exact item being sold, photographs should be considered representative of the product.
Actual products may differ in appearance due to manufacturer production changes, finishes, packaging, accessories, lighting, photography, or other variations that do not materially change the product ordered.
Customers should rely on the product description, manufacturer model number, SKU, UPC, specifications, and other identifying information when confirming the product being purchased.
9. Payment
TSFirearm.com accepts supported credit and debit card payments made available through our checkout system.
The total amount presented at checkout will include applicable product charges, shipping charges, taxes, and other charges disclosed before the order is submitted.
TS Firearm does not currently impose a separate credit-card processing surcharge on website orders.
Payment may be subject to authorization, fraud screening, and verification by TS Firearm and our payment service providers.
TS Firearm may cancel or hold an order if payment cannot be authorized or if we reasonably suspect fraudulent, unauthorized, or unlawful activity.
10. Sales Tax
Applicable sales tax may be collected based on the transaction, shipping destination, and applicable law.
Customers remain responsible for any taxes, fees, duties, or other governmental charges for which they are legally responsible and that are not collected by TS Firearm at checkout.
11. Cancellations
All sales are final.
Orders should be considered binding once submitted. However, before an order has shipped or entered final fulfillment, TS Firearm may, at its discretion, approve a customer-requested cancellation.
Approved customer-requested cancellations are subject to a 15% cancellation fee.
Submitting a cancellation request does not guarantee that the order can be canceled. Orders may enter processing or distributor fulfillment shortly after they are submitted.
Once an order has shipped, it cannot be canceled.
The 15% cancellation fee does not apply when TS Firearm cancels an order because TS Firearm or its distributor is unable to fulfill the order, or when TS Firearm determines that the order cannot lawfully be fulfilled through no fault of the customer.
Additional details are provided in our Return & Cancellation Policy.
12. Shipping and Processing
Orders may require up to seven (7) business days to process after TS Firearm has received the payment, FFL information, and any other information or documentation necessary to fulfill the order.
Processing time is separate from carrier transit time.
TS Firearm selects carriers and shipping services based on the product, destination, applicable carrier requirements, legal requirements, cost, and other operational considerations.
Shipping estimates are estimates and are not guarantees.
Some products may ship directly from a distributor, and an order containing multiple products may arrive in separate shipments.
If circumstances prevent TS Firearm from shipping within a timeframe represented to the customer, TS Firearm will address the delay, cancellation, and any required refund in accordance with applicable law.
Please review our Shipping Policy for additional information.
13. Shipping Insurance and Carrier Issues
Shipping insurance may be available for certain orders and is not included unless expressly stated or purchased.
If an order is lost, damaged, or otherwise affected while in transit, please contact TS Firearm promptly so that we can determine the appropriate carrier, insurance, or claims procedure.
Claims involving insured shipments are subject to the applicable carrier or insurance requirements.
TS Firearm does not guarantee carrier delivery dates and is not responsible for delays caused by carriers or circumstances outside our reasonable control, subject to rights and remedies that cannot be waived under applicable law.
14. Returns
Except as expressly provided in these Terms or our Return & Cancellation Policy, all sales are final and TS Firearm does not accept returns.
This policy applies to firearms and non-firearm products unless otherwise expressly stated.
Nothing in these Terms limits any rights or remedies that cannot legally be waived.
15. Firearm Inspection and Safe Use
Firearms are inherently dangerous products and must be handled, stored, maintained, and used responsibly and in accordance with applicable law and manufacturer instructions.
Before firing or using a firearm purchased from TS Firearm, the customer should inspect the firearm and, when appropriate, have it inspected by a qualified gunsmith to confirm that it is in safe operating condition.
Always read and follow the firearm manufacturer’s instructions, warnings, maintenance requirements, and safety procedures before use.
Do not use a firearm that appears damaged, defective, improperly assembled, modified in an unsafe manner, or otherwise unsafe to operate.
TS Firearm is a retailer and does not manufacture the firearms it sells. Manufacturer warranties, warnings, instructions, and product-safety information remain applicable to products purchased through TS Firearm.
16. Manufacturer Warranties and Defective Products
New firearms and other products may be covered by warranties provided by their respective manufacturers.
Unless expressly stated otherwise, TS Firearm does not provide an independent product warranty.
If a new firearm or other product develops a manufacturing defect, the applicable manufacturer’s warranty and service procedures generally apply.
Customers should inspect firearms before accepting transfer whenever reasonably possible. If significant shipping damage, an incorrect firearm, or another apparent problem is discovered at the receiving FFL, contact TS Firearm before completing the transfer.
TS FIREARM HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON ALL FIREARMS EXCEPT AS OTHERWISE STATED HEREIN.
17. Customer Accounts
The Site may allow customers to create an account for features such as reviewing orders, managing addresses, or simplifying future purchases.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You agree to provide accurate information and promptly update information that becomes inaccurate.
TS Firearm may suspend or terminate accounts associated with fraud, abuse, unlawful conduct, security concerns, or violations of these Terms.
18. Electronic Communications and Marketing
By using the Site or providing an email address in connection with an order or account, you consent to receiving electronic communications reasonably necessary to administer your transactions and relationship with TS Firearm, including order confirmations, shipping notices, account notices, security communications, and customer-service messages.
Where permitted and with any consent required by applicable law, customers may also elect to receive marketing emails from TS Firearm.
Marketing communications may be unsubscribed from using the unsubscribe mechanism provided in the communication.
TS Firearm does not currently use SMS/text messaging as a marketing channel unless expressly disclosed and separately authorized.
19. Automated and Artificial Intelligence Tools
TS Firearm may use automated technologies, including artificial intelligence-powered tools, to assist with website functionality, customer service, product discovery, communications, fraud prevention, or other business operations.
When required by applicable law, customer-facing automated or artificial intelligence systems will be identified or otherwise disclosed appropriately.
Information generated by an automated or artificial intelligence system may contain errors and is provided for general assistance only.
Do not rely on an automated or AI-generated response to determine whether you are legally eligible to purchase, possess, receive, transfer, transport, or use a firearm, ammunition, magazine, or other regulated product.
Customers remain responsible for verifying applicable legal requirements through appropriate authoritative sources or qualified professionals.
20. Third-Party Services and Links
The Site may rely on or link to services operated by third parties, including payment processors, shipping carriers, FFL-related services, manufacturers, distributors, analytics providers, advertising services, and other technology providers.
TS Firearm is not responsible for the independent practices, content, availability, or policies of third-party websites and services.
Your use of a third-party service may also be governed by that provider’s terms and privacy policies.
21. Website Content and Intellectual Property
Unless otherwise indicated, the Site and its original content, design, text, graphics, logos, photographs, software, and other materials are owned by or licensed to TS Firearm and are protected by applicable intellectual-property laws.
You may use the Site for lawful personal shopping and informational purposes.
You may not reproduce, distribute, modify, scrape, systematically extract, commercially exploit, interfere with, reverse engineer, or misuse the Site or its content except as permitted by applicable law or with prior written authorization.
Manufacturer names, trademarks, product images, and other third-party materials remain the property of their respective owners.
AI-Generated and Illustrative Imagery
Some promotional and decorative images on the Site are created or modified using artificial intelligence. These images are used for illustrative purposes and may include fictional people, locations, products, or scenes. They are not intended to represent photographs of TS Firearm’s actual personnel, premises, inventory, or customer experiences.
Promotional illustrations do not establish the specifications, condition, included accessories, or availability of any product offered for sale. Please review the applicable product listing and contact TS Firearm before purchasing if any information is unclear. Nothing in this section changes the product description or limits any rights or remedies available under applicable law.
22. Prohibited Use
You may not use the Site:
- for unlawful or fraudulent purposes;
- to purchase or attempt to purchase a product you are legally prohibited from possessing or receiving;
- to provide false or misleading identity, payment, shipping, FFL, or eligibility information;
- to interfere with the operation or security of the Site;
- to introduce malicious code or attempt unauthorized access;
- to impersonate another person or entity; or
- in any manner that violates applicable law or these Terms.
TS Firearm may refuse service, cancel transactions, restrict access, or report suspected unlawful activity when reasonably appropriate.
23. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TS FIREARM DOES NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
PRODUCT WARRANTIES, IF ANY, ARE PROVIDED BY THE APPLICABLE MANUFACTURER UNLESS TS FIREARM EXPRESSLY STATES OTHERWISE.
NOTHING IN THIS SECTION DISCLAIMS WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE DISCLAIMED.
24. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TS FIREARM LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE.
THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
Nothing in these Terms is intended to excuse unlawful conduct by TS Firearm or eliminate rights that applicable law does not permit a seller to waive.
25. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless TS Firearm LLC and its owners, officers, employees, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Site, your material violation of these Terms, your provision of false or misleading information, or your unlawful purchase, possession, transfer, transport, or use of a regulated product.
26. Governing Law
These Terms and transactions with TS Firearm are governed by the laws of the State of Montana and applicable federal law, without regard to conflict-of-law principles, except to the extent another jurisdiction’s law applies and cannot lawfully be waived.
[ATTORNEY REVIEW: TS Firearm should determine with counsel whether it wants a specific Montana venue provision, mandatory arbitration provision, jury-trial waiver, and/or class-action waiver. Those provisions have intentionally not been added to this draft without legal approval.]
27. Changes to These Terms
TS Firearm may update these Terms periodically to reflect changes in our business, Site functionality, policies, technology, or applicable law.
The “Last Updated” date at the top of this page indicates when these Terms were most recently revised.
Changes apply prospectively from the effective date of the updated Terms unless otherwise required by law.
28. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
29. No Waiver
A failure by TS Firearm to enforce a provision of these Terms in a particular instance does not constitute a waiver of that provision or our right to enforce it in the future.
30. Entire Agreement
These Terms, together with the policies incorporated by reference and any additional terms presented and accepted in connection with a particular transaction, constitute the agreement between you and TS Firearm regarding your use of the Site and purchases through the Site.
